Entenda todos os detalhes a seguir!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-justica-suspense-norma-de-farmaceuticos-para-prescreveram-medicamentos\"><strong>Justi\u00e7a suspense norma de farmac\u00eauticos para prescreveram medicamentos<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com o juiz respons\u00e1vel pela suspens\u00e3o, Ala\u00f4r Piacini, a resolu\u00e7\u00e3o infringe a <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2011-2014\/2013\/lei\/l12842.htm\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Lei N\u00ba 12.842<\/strong><\/a>, conhecida como a &#8220;Lei do Ato M\u00e9dico&#8221;. Al\u00e9m disso, a determina\u00e7\u00e3o impede que o CFF envie um novo ato normativo com mat\u00e9ria semelhante, bem como\u00a0<strong>divulgar amplamente sobre a decis\u00e3o judicial\u00a0<\/strong>por meio de sua p\u00e1gina oficial e demais meios de comunica\u00e7\u00e3o institucionais. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A determina\u00e7\u00e3o foi divulgada no dia <strong>31 de mar\u00e7o de 2025<\/strong>, bem como uma <a href=\"https:\/\/portal.cfm.org.br\/noticias\/vitoria-da-medicina-justica-suspende-prescricao-de-medicamentos-por-farmaceuticos\" target=\"_blank\" rel=\"noreferrer noopener\">nota do Conselho Federal de Medicina<\/a> que apoia a decis\u00e3o do ju\u00edz. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Confira a seguir a norma publicado pelo conselho e o que permitia anteriomente!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-resolucao-permitia-que-farmaceuticos-prescrevessem-medicamentos\"><strong>Resolu\u00e7\u00e3o permitia que farmac\u00eauticos prescrevessem medicamentos<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com a resolu\u00e7\u00e3o publicada pelo <strong>Conselho Federal de Farm\u00e1cia<\/strong> (CFF), seria poss\u00edvel que farmac\u00eauticos prescrevessem medicamentos, at\u00e9 mesmo aqueles que exigissem receita m\u00e9dica. A norma foi divulgada no Di\u00e1rio Oficial do dia 17 de mar\u00e7o, e passaria a valer no m\u00eas de abril de 2025.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-o-que-a-nova-resolucao-permitia-aos-farmaceuticos\"><strong>O que a nova resolu\u00e7\u00e3o permitia aos farmac\u00eauticos?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Preliminarmente, a norma publicada pelo Conselho Federal de Farm\u00e1cia permitia a\u00a0<strong>possibilidade de os farmac\u00eauticos executarem novas atribui\u00e7\u00f5es<\/strong>, como:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prescri\u00e7\u00e3o de medicamentos, incluindo aqueles de venda sob prescri\u00e7\u00e3o m\u00e9dica;<\/li>\n\n\n\n<li>Renova\u00e7\u00e3o de prescri\u00e7\u00f5es previamente emitidas por outros profissionais de sa\u00fade legalmente habilitados;<\/li>\n\n\n\n<li>Realiza\u00e7\u00e3o de exame f\u00edsico para avalia\u00e7\u00e3o de sinais e sintomas;<\/li>\n\n\n\n<li>Solicita\u00e7\u00e3o e interpreta\u00e7\u00e3o de exames para avalia\u00e7\u00e3o da efetividade do tratamento; e<\/li>\n\n\n\n<li>Coleta de dados por meio da anamnese farmac\u00eautica.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cfm-publica-comunicado-contra-a-resolucao\"><strong>CFM publica comunicado contra a resolu\u00e7\u00e3o<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ap\u00f3s resolu\u00e7\u00e3o publicada, o Conselho Federal de Medicina (CFM) emitiu um comunicado contra&nbsp;a nova norma do CFF. De acordo com o conselho, a resolu\u00e7\u00e3o \u00e9 absolutamente ilegal e desprovida de fundamento jur\u00eddico. Tamb\u00e9m argumenta que a prescri\u00e7\u00e3o de medicamentos exige investiga\u00e7\u00e3o cl\u00ednica, diagn\u00f3stico e defini\u00e7\u00e3o de tratamento,<strong>&nbsp;compet\u00eancias privativas dos m\u00e9dicos conforme a Lei do Ato M\u00e9dico<\/strong>.&nbsp;Ainda, destaca que&nbsp;<strong>a forma\u00e7\u00e3o acad\u00eamica dos farmac\u00eauticos n\u00e3o contempla treinamento adequado&nbsp;<\/strong>para avalia\u00e7\u00e3o cl\u00ednica, determina\u00e7\u00e3o de terapia ou gerenciamento de eventuais efeitos adversos dos medicamentos. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O Conselho tamb\u00e9m critica o fato de a nova resolu\u00e7\u00e3o<strong>&nbsp;reeditar uma tese j\u00e1 derrubada anteriormente pela Justi\u00e7a<\/strong>, o que, na vis\u00e3o da entidade, caracteriza prevarica\u00e7\u00e3o por parte do CFF.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-fe48e5de wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/portal.cfm.org.br\/noticias\/prescricao-de-medicamentos-por-farmaceuticos-e-ilegal-e-coloca-pacientes-em-risco-alerta-cfm\" target=\"_blank\" rel=\"noreferrer noopener\">Confira o comunicado na \u00edntegra aqui!<\/a><\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Desse modo, o CFM alegou que tomar\u00e1 medidas judiciais e administrativaspara&nbsp;<strong>suspender a resolu\u00e7\u00e3o e responsabilizar os dirigentes do CFF por eventuais danos causados \u00e0 sa\u00fade da popula\u00e7\u00e3o<\/strong>.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-manifestacao-do-cff\"><strong>Manifesta\u00e7\u00e3o do CFF<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ap\u00f3s repercuss\u00e3o da norma, o CFF tamb\u00e9m divulgou um pronunciamento, que alega que os <strong>farmac\u00eauticos conquistaram o direito \u00e0 prescri\u00e7\u00e3o de medicamentos no Brasil h\u00e1 12 anos<\/strong>:<\/p>\n\n\n\n<pre class=\"wp-block-verse\">\u201cSobre a Resolu\u00e7\u00e3o n\u00ba 5\/2025, ressalta-se que n\u00e3o h\u00e1 nenhuma novidade em rela\u00e7\u00e3o \u00e0 prescri\u00e7\u00e3o em si.
